
Brittany Cartwright and Jax Taylor’s newly agreed upon custody deal for their four-year-old son Cruz includes a number of restrictions, including one that forbids either of The Valley stars from being under the influence of alcohol or illegal drugs while Cruz is in their care.
According to Us Weekly, the exes agreed in court this week that neither will be required to pay child support, as each parent will be responsible for all costs and expenses associated with Cruz when he’s in their custody.
The documents go on to note that Jax will have custody of Cruz every other weekend, as well as every Wednesday night. The former couple also agreed to joint legal custody and responsibility when it comes to making decisions for their son’s health, education and general welfare; however, in the event that Brittany and Jax are unable to come to an agreement regarding health decisions for Cruz, Brittany will be allowed to have the final say. (As The Ashley previously reported, Brittany revealed in April 2025 that Cruz was diagnosed with autism in 2024 and is mostly non-verbal.)
The custody agreement not only forbids both Jax– who went public about his decades-long cocaine addiction prior to ‘The Valley’ Season 2 premiere– and Brittany from being under the influence of alcohol, marijuana, or any form of illegal drugs while Cruz is in their care, it also states that Cruz is not to meet either parent’s future significant other for a period of six months.
The former Vanderpump Rules stars have also agreed to celebrate their son’s birthdays together and not to speak negatively about each other in Cruz’s presence.

As fans of ‘The Valley’ know, Brittany filed for divorce in August 2024 following a six-month separation from Jax. While Brittany maintained earlier this year that she and Jax chose to separate in 2024 so that they could both be “better parents” to Cruz, she revealed on Harry Jowsey’s Boyfriend Material podcast in January that she and Jax continue to struggle when it comes to co-parenting, describing their dynamic as “up and down.”
Brittany also explained on the podcast episode that her and Jax’s divorce has yet to be finalized because it continues to get pushed back.
“There’s just been a lot of things that were happening and [Jax] didn’t turn in things on time, or they needed something from me, or [Jax] was out of town for something and we had to move the date, so it’s always just been something happening,” she stated, before admitting that the divorce process has been far more involved than she imagined it would be.

While Brittany’s post-split journey is set to continue in Season 3 of ‘The Valley,’ viewers won’t get to see Jax’s side of the breakup, as the former SUR bartender announced in July that he would be stepping away from the Bravo series after Season 2 in order to focus on his sobriety and mental health.
