Jenelle Evans wants a divorce….and it looks like she may finally get it this week!

The Ashley can exclusively reveal that the fired Teen Mom star will have the chance on Friday to plead with the judge to finally officially end her marriage to David Eason. A hearing was set after Jenelle filed paperwork last month demanding the judge in (one of) her divorce court cases grant her the “absolute divorce” she filed for back in May. In that filing (which is different from the “divorce from bed and board” she filed for in February 2024), Jenelle asked that the court sever her marital ties to David and legally restore her last name back to Evans. 

In the court paperwork filed by her attorney in June, Jenelle writes that there “are no genuine issues of material fact” keeping the divorce from being granted and that she is “entitled to judgment as a matter of law.”

“…[Jenelle] prays for entry of summary judgement in favor of the Plaintiff granting Plaintiff an absolute divorce,” Jenelle’s filing reads.

Jenelle’s motion is basically informing the judge that no one (including a certain swampy aspiring “rapper”) is disputing this divorce, so it should just be granted.

“I reckon them talkin’ words are about me!”

The Ashley can exclusively reveal that a non-jury hearing has been scheduled for Friday. The judge will give the couple 15 minutes to hopefully wrap up this matter and officially end the marriage. 

“Let’s finally stick a fork in this crapshow of a marriage! It’s been a steamin’ meatloaf from hell since tha beginning!”

It appears that the hearing will be held virtually, as Jenelle lives in Nevada and the hearing will be held in North Carolina.

Again, this court case is different from the civil case Jenelle filed in February 2024. Those proceedings— which deal with custody of their daughter Ensley, marital property distribution, child support and more— are still ongoing. The couple was supposed to meet earlier this week for a mediation hearing for that case; however, that court date has been continued until August.

As The Ashley previously reported, North Carolina law requires a couple who is seeking a divorce to be legally separated and living apart for one year (with no hanky-panky) before they can officially file for a divorce. (Jenelle had previously filed for a “divorce from bed and board” which is essentially a court-ordered legal separation that does not end the marriage.) Once that year has passed, the couple can officially file for divorce, which Jenelle did in May.

In court documents obtained by The Ashley, Jenelle lists the date of her and David’s separation as February 16, 2024. 

“He ain’t laid a hand on my cooter or tooter since then, judge!”

“At the time of the separation, at least one of the parties intended the separation to be permanent,” the court docs from that filing read. “Since the date of separation, the parties lived continuously separate and apart from each other and did not resume the marital relationship.”

As fans know, David moved on very quickly after splitting from Jenelle, finding a new live-in lover in Kenleigh Heatwole. Jenelle also immediately moved on following her split from David. The former Lady ‘O’ The Land (HIGH!) HIGH-tailed it to Las Vegas, to date her manager-turned-soulmate “August Keen.” After a chaotic year or so together (and plenty of 911 calls and social media bickering sessions), the couple called it quits in January

Despite the fact that Jenelle isn’t divorced yet, she still hosted a (delightfully cringe-tastic) “divorce party” for herself last month at a New York City strip club (as one does…)

  2. I hope when it is all said and done she loses all around. She has mental problems and she is screwing up all them kids.


  3. It’s funny how the cops have never been called for David since he left her. Not counting what is going on with Jace.


    1. That’s only because David has not trapped Kenleigh yet. As soon as he does, the real controlling monster in him will come out.


    2. Maybe he didn’t show his true colors to Kenleigh yet. Remember that he wasn’t violent just with Jenelle


    3. It’s called the “Honeymoon Period.” If abusive partners were abusive right out of the gate, they’d have a harder time trapping their victim.


    4. Thee is normally a honeymoon period before abusers kick into gear, otherwise people would leave immediately. They use try to push the victim into isolation so they don’t have a safety net, tie them down in some ways, and then the abuse starts.

      Looking out for someone isolating and controlling you etc is one of the best red flags to look out for from my experience. And I grew up in an abusive family, yay multigenerational military w ptsd in multiple generations! And on both sides to boot.


    5. Yeah, he is probably in the honeymoon stage with his new child bride still lol. That, or she’s just not saying anything and is covering swamp bro’s butt while he treats her like trash/murders her dog under the table. SMH abusers aren’t usually gonna be 0 to 100 right from the get go – they like to wait and get comfy. Makes me actually even more suspicious now that I think about this comment as he likely picked somebody so young because they are usually easy to control and is just waiting for his moment (i.e. he gonna knock her UPPP)


  4. North Carolina is deep south and backwards. I grew up there. My sister was divorced from an abusive POS there and it was dragged out like this against her will and her safety. It’s not to keep people from breaking up and getting back together and tying up the courts like another person said. It’s literally to make the process more difficult and promote “the sanctity of marriage.” Many politicians have openly admitted this. Church and state are supposed to be kept separate but the fundamentalist Baptists control North Carolina.


    1. I was also divorced from my first husband in North Carolina. He was also an abusive pos and I had still had to do the year long waiting period, it was absolutely archaic.


      1. Sorry you had to go through that, both the relationship and the difficult divorce.

        If they are going to have waiting periods, there should at least be exemptions for abuse, criminal activity etc imo.


      2. Me as well. He was stalking me and having other people follow me around. Cops wouldn’t do anything without proof. Im like how do you really prove you are being stalked. They wanted pictures. Crazy. That’s why it kinda annoys me when people put a protective order against someone for practically nothing and the courts grant it.

  6. Being a Jenelle hater aside, I’m not sure I understand why it’s this difficult to get a divorce. I feel like all these hoops are probably keeping people and their kids in abusive marriages. Why can’t you just file for divorce and have it done with? Are they disputing property or something?


    1. It doesn’t keep anyone in abusive marriages. Doesn’t force you to stay with your spouse, on the contrary, you must live apart for 1 year before you can get divorce. What it does is prevent people from filling because they’re mad at each other just to reconcile later. It saves the courts a lot of wasted time


      1. Exactly. You don’t have to be divorced to live apart. As clearly shown with Jenelle and David’s whole ordeal.


      1. We have the same law here in Maryland. Plus I couldn’t have my ex served because I had no idea what his address was. So I had to post the filing on an actual bulletin board at the court house. Crazy!

I believe the one year rule is on the books to dissuade those couples that constantly fight, break up and make up from filing for divorce on a whim and than getting back together with their partner. Things like that can really tie up the courts and legal system. Kinda like every time a teen mom files an order of protection on their baby daddy aka Kail. It’s a strain on the system.
