
Falen Vaughn is fighting back against the two criminal charges she caught last month during an altercation with Hunter Johnson‘s stepmom and father.
The Ashley can exclusively reveal that the Unexpected grandma filed a motion in court on Wednesday to have her charges of disorderly conduct and obstructing governmental operations dismissed, claiming she was not disobeying the orders of the officers on the scene that night. She also criticized the police officers for their own alleged misconduct against her, as well as Hunter and her husband Kris Vaughn!
As The Ashley previously told you, Falen was arrested on April 20 outside of Hunter’s dad Casey Johnson‘s home. Footage from the officers’ body worn camera shows Falen and Kris rolling up to Casey’s home shortly after Hunter’s mom Stacie Riddle reportedly got into an altercation with Hunter’s stepmom Brettney.
In the footage from that night, the officers are heard ordering Kris to calm down, and soon Kris gets in his truck and seems to stop dangerously close to where another officer is standing.

The footage shows Falen trying to jump into the situation, but the officer is holding her arm to keep her back while also telling her repeatedly to stop. Falen is screaming at Brettney and tries to lunge at someone, so the officer took her to the ground. Meanwhile Kris can be heard yelling that Falen is a “defenseless woman.”

In the Motion to Dismiss Falen filed on Wednesday, however, Falen denies most of what the officer later wrote in his affidavit regarding the events of that night.
Not only that, but she also calls out several of the officers present that night for writing a plethora of “misrepresentations and falsehoods” about her and Kris’ actions that night. She claims that the cops bumbled things with her arrest by failing to read her Miranda rights, allegedly forgetting to seatbelt her into the police cruiser, and possibly speaking to 14-year-old Hunter without permission from his parents, among other things.

As The Ashley previously told you, Falen entered a plea of not guilty, which she maintains as of press time.
Falen told her version of events in her Motion to Dismiss. She claimed that, on the night of her arrest, her daughter Bella and grandson Wes attended Hunter’s baseball game with his mom, Stacie. Stacie dropped Hunter off at his dad’s house, as she was required to by court order, but Bella (who was on the phone with Hunter) soon became alarmed when Hunter told her that Brettney had “snatched his phone from himm and they were now in a physical altercation.” Falen claims Hunter screamed to Bella over the phone to call 911 and then the phone call ended. Hunter’s mom did call 911— and high-tailed it back to Hunter’s dad’s house to “make sure [Hunter] was not harmed.”
Falen admits Stacie got out of the car and went to the house to confront Hunter’s stepmom, while Bella and the baby remained in the car. (Bella was reportedly driving.) An officer soon arrived, and Falen claims that Bella was told she was not allowed to leave, despite her not being involved in any of the altercation.
Falen claims that Bella called her and informed her that the cops won’t let her leave, prompting Falen to drive over the Hunter’s dad’s house.

“At no time did [Falen] enter onto [Casey’s] property,” Falen claims in the motion.
She added that she told the cops she was only there to get Bella and Wes. Falen states that she complied with all of the officer’s requests, and answered all of his questions. Falen also claims she told the cops that her only reason for being there was to get her daughter and grandson out of there. Around that time, Falen states that Kris arrived, and Falen admits he was “agitated,” causing the officer to push Kris back and tell him to calm down. Falen claims she was only trying to “deescalate the situation.”
She admits that, after Kris was ordered to drive off, she did once again start screaming at Hunter’s dad and stepmom, blaming them for the ruckus. She claimed that an officer told her to “stay back” and grabbed her arm, and she admits that she did pull arm away from the officer.
“Even though Falen stopped her forward movement and stopped yelling at Brettney and Casey, Officer Wasson grabs Falen in a chokehold and throws her to the street face first,” Falen writes, adding that she was then cuffed and put into the back of the police car.

Next, Falen claims that the officer forgot to seatbelt her into the car.
“Apparently realizing his mistake halfway through his drive to the police station, he pulls over on the side of the road and secures a seatbelt around her,” Falen writes. “Officer Wasson did not read Falen her Miranda Rights at any time.” (She adds in a footnote that none of the officers present that night read her the Miranda Rights.)
Falen then disputed what the officer wrote in the Affidavit for Probable Cause he filled out, which prompted Falen to be arrested. She claims that the officer insinuated that she was uncooperative or refused to answer his questions, things she denies.
“Neither instance is true and Officer Wasson’s narrative is a misrepresentation of the facts,” Falen writes.

Falen also denies that the officer had any reason to feel that the safety of another officer on the scene was in question. (As The Ashley told you, the officer’s body worn camera footage shows Kris getting into his truck and driving very fast, seemingly stopping just short of where an officer was standing in the street.)
She insists that Officer Wasson’s claims that the other officer was in danger due to Kris’ actions is false.
She does claim, however, that she was in danger, due to the officer’s “unnecessary and excessive force” when taking her to the ground to arrest her.
“His after-the-fact claim of ‘officer safety’ is a mere pretext for his desire to use unnecessary force in this situation,” Falen wrote.
She also pointed out that the footage shows that the officer who arrested her never told the other police officers that Falen was trying to “fight” him, as he wrote in the Affidavit. She points out the officer also falsely claimed that he thought Kris was going to fight the other officers; however, according to Falen, her husband had already driven away.
“There was not a fight,” Falen insists. “Kris Vaughn had already left the area.”

Falen admitted she was questioned about the cellphone she gave Hunter to use to communicate with them (which Hunter’s dad had forbidden). That phone— which was the one Hunter’s stepmom confiscated— was a source of contention among all the adults, and Falen claims she told the officers that she wanted it back (since she paid for it), if Hunter wasn’t going to be allowed to have it.
She also stated that one of the officers spoke to Hunter at the scene and made an “unsolicited and incorrect statement” to the 14-year-old about him only having to wait a few years before he’ll be able to decide which parent he’d like to live with.

“It is unknown, but not likely, that [the officer] obtained from Casey Johnson or Stacie Riddle ([Hunter’s] parents) to speak with [Hunter], age 14,” she writes.
Finally, Falen writes that “dismissal of the case is warranted,” due to the fact that she did not purposelessly act with recklessness to cause harm, etc.
“[Falen] arrived at the scene for one purpose– because her 16-year-old daughter had called her for help,” the motion reads, adding that Falen “made it clear” to officers that she would leave the scene as soon as she got Bella and Wes out of there.
She condemned the officers for not allowing her, Bella and Wes to leave, despite the fact that they had no part in the altercation between Brettney and Stacie that originally brought officers to the home.
“There was no reason for them to continue to be detained,” Falen wrote. “A disorderly conduct charge in this instance is not warranted, and the count should be dismissed.”
Falen also denied that she had interfered with the officers’ duties that night, and even pointed out that one of the officers seemed to be trying to figure out something to charge her with. She claimed one of the officers stated that Falen wasn’t resisting.
“They were clearly trying to decide what to charge her with because they were not sure if any crime had even been committed,” she wrote.
As of press time, the judge has not ruled on Falen’s motion to have her charges dismissed. She is next due in court on August 6.

Also really hope the police investigation is subpoenaing the phone records from that phone.
