Things just got worse for Jenelle Evans‘ husband David Eason.
The Ashley can exclusively confirm that the fired Teen Mom 2 dad has just been charged with “Assault by Strangulation,” in addition to the misdemeanor child abuse charge he received in October. The charges stem from an incident in September in which Jenelle’s teen son Jace told authorities that he was allegedly assaulted by David.
“Assault by Strangulation” is a felony charge in North Carolina, which is why David’s case was moved from his county’s District Court to Superior Court. (The Sun was the first to report this news on Friday.)
As The Ashley previously reported, David was supposed to go to court for his child abuse charge on January 18; however, (for reasons unknown to The Ashley), he had his hearing on January 10. (The Sun states that there was a grand jury on this date.)
However, The Ashley’s sources tell her that the court hearing on the 10th was “uneventful,” with David simply getting the child abuse case continued.
“Jenelle and David had no clue about the felony charge until they read The Sun‘s article on Friday,” one source said. “They were not told by the court or the attorneys or anyone. This just happened. They may not even know that the felony charge is for assault [by strangulation].”
In North Carolina, a victim must have sustained physical injury in order for the alleged assaulter to be charged with ‘Assault by Strangulation.’ It is a Class H felony, and carries a maximum of 39 months in prison.
The official court summons issued in October claims that David “willingly” harmed Jace during the September incident.
“[David] unlawfully and willingly did, being the parents of Jace V Evans, who was a child, less than 16 years of age, inflict physical injury on that child,” the court document states. “The physical injury inflicted caused marks on [Jace’s] right arm, and left and right side of the neck, and was inflicted by other than accidental means.”
Jenelle’s mom Barbara Evans revealed to the cops what Jace allegedly told her about David assaulting him.
“Made contact with Barbara who advised [Jace] was not at the residence…” the police report states. “She advised that she had spoken to [Jace] earlier in the evening when he called from an unknown number and told her about being assaulted by David Eason and that he ran away and was hiding…”
Jenelle and David have consistently denied that any abuse took place. However, after Jenelle found out that David now has a felony charge, she took to social media to blast the county officials.
“Can’t even call for concerns about them causing mass chaos because I get threatened to get thrown in jail, nice,” Jenelle wrote on Facebook. “It’s okay, you will all see the light eventually.”
A court source confirmed to The Ashley that Jenelle did indeed call the county on Friday to blast them for not informing her and David of the charge… and it did not go over well with the county officials. (More on that later….)
Jenelle also posted a series of comments on Facebook, writing, “I’m over here minding my own business, trying to post positive content and people are constantly trying to bring me down..”
In another post, Jenelle complained that she and David have been the victims of corruption. (That post has since been deleted, though.)
“I live in the most corrupt place in the world,” Jenelle— who obviously has not heard of North Korea— wrote. “It’s funny how bias people are against us….when the truth comes out I hope you feel stupid. I can not stand where I live. The feds should be looking into all the corruption I’ve dealt with for years with the law enforcement of North Carolina. Anyway, a new court date has not been given for David as of press time.

If anyone laid a hand on my kid- whether it be their father or not, I would not stick by them and make my child seem to be the one in the wrong. No matter what Jace said or did- he should not be touched in anyway that hurts him!
She is no mother. I can’t Believe she’s sticking with him…. She needs the other kids to be taken out of her care. Hopefully when he gets found guilty conditions of his release/parole is that he’s not to be around minors. She left him once before when the kids got taken off them but went back to him as soon as it was all sorted.

Owing to the Only If It’s In My Own Back Yard mindset, however, the prevailing collective attitude (implicit or subconscious) basically follows: ‘Why should I care — my kids are alright?’ or ‘What is in it for me, the taxpayer, if I support social programs for other people’s troubled families?’
While some people will justify it as a normal thus moral human evolutionary function, the self-serving OIIIMOBY can debilitate social progress, even when social progress is most needed. And it seems this distinct form of societal penny wisdom but pound foolishness is a very unfortunate human characteristic that’s likely with us to stay.
As a moral rule, a physically and mentally sound future should be every child’s fundamental right — along with air, water, food and shelter — especially considering the very troubled world into which they never asked to enter.
People will continue procreating regardless of their inability to parent their children in a psychologically functional/healthy manner. And many seem to perceive thus treat human procreative ‘rights’ as though they [people] will somehow, in blind anticipation, be innately inclined to sufficiently understand and appropriately nurture their children’s naturally developing minds and needs.
As liberal democracies, we cannot prevent anyone from bearing children, including the incompetent and reckless procreators. We can, however, educate all young people for the most important job ever, even those high-schoolers who plan to remain childless.
If nothing else, such child-development curriculum could offer students an idea/clue as to whether they’re emotionally suited for the immense responsibility and strains of parenthood. Given what is at stake, should they not at least be equipped with such valuable science-based knowledge?
Understanding the science behind every child’s healthy/functional development can at least enable a prospective parent to make an educated decision on how they wish to go about rearing any future children.
Abuse left unhindered prolongedly readily results in a helpless child’s brain improperly developing. The emotional and/or psychological trauma acts as a starting point into a life in which the brain uncontrollably releases potentially damaging levels of inflammation-promoting stress hormones and chemicals, even in non-stressful daily routines.
It can amount to non-physical-impact brain-damage abuse: It has been described as a continuous, discomforting anticipation of ‘the other shoe dropping’ and simultaneously being scared of how badly you will deal with the upsetting event, which usually never transpires.
The lasting emotional/psychological pain from such trauma is very formidable yet invisibly confined to inside one’s head. It is solitarily suffered, unlike an openly visible physical disability or condition, which tends to elicit sympathy/empathy from others.
It can make every day a mental ordeal, unless the turmoil is prescription and/or illicitly medicated. [To a significant degree, I know such self-medicating from personal experience.]
The wellbeing of all children — and not just what other parents’ children might/will cost us as future criminals or costly cases of government care, etcetera — should be of great importance to us all, regardless of whether we’re doing a great job with our own developing children. And a healthy future should be every child’s fundamental right, especially since they never asked to enter this very troubled world!

It really depends on the judge. But, this time is different because the victim is a child.
Essentially, Judge will consider his previous arrests, any records of domestic violence, and It’s really not good (for him) that the victim is a child. You could expect the judge to throw the book at him, BUT based on how the courts have been so lenient on them in the past , it’s hard to tell.
*her comments accusing the judge of being corrupt bring a lot of doubts in to their jurisdiction. I guarantee you the judge will be aware and when he becomes aware it will piss him off. You really don’t want to piss off the judge who is overseeing your case.

That’s the problem. He probably WON’T go to jail!! As we have all seen, both David and Jennelle have multiple arrests and many many problems with the law, yet they always get away with it. North Carolina is one of the worst states when it comes to prosecuting people for child abuse. David has been accused several times for abusing Kaiser and the courts just ignored it. Jenelle and David will always walk away from this kind of case because of the liberal law on child abuse in North Carolina. In fact, I’m sure she will change her mind about moving from there once she realizes that in most other states, she and David would be dealt with properly and those kids would’ve been taken from them long ago.

My heart is literally breaking for Jace. That monster had no business physically assaulting him. Even if jace was in the wrong he had no right to assault him. GOOD!! Let’s hope he’s convicted. Losing his precious guns would probably be a worse punishment for him than some time in the clink. And he’s so stupid and has zero impulse control that he’ll probably continue to have guns, inevitably get caught when cops are called on him for whatever harmful activities he’s up to, then back into prison. It’ll be a never ending cycle.
Hopefully if he is convicted & has to surrender his guns, it will decrease the amount of danger the kids are in, even if it’s only by a little bit.
I know that regardless of whether Jenelle’s unemployed, broke, unambitious, and lazy financial liability husband has his firearms or not, he is and will always be a potentially lethal threat to the kids’ health, safety, wellbeing and survival due to him being an domestic violence abuser. But if the guns get removed from his possession and home by the government, then that’s one less lethal tool for that unemployed loser of a man to have at his disposal to use against the kids.
If the state of North Carolina is not going to remove the kids from that dangerous life threatening hell hole of a house that they call home and allow the kids to continue suffer from t living in the abusive environment they’re in, then the least the system can do is remove the weapons from the broke unemployment child beating loser possession so that he can not use them while he’s abusing the children.
That’s the bare minimum the system can do for these kids. If they are not going to save them, then at least do something to reduce the amount of danger, pain, suffering, fear, and the degree to which their literal lives are put in danger by simply living in the type of hell hole they’re currently residing in.

Court is a long drawn out process no matter what it is for. Mine kept getting continued when I took my ex back to court for full custody as we had 50/50, but he went to jail & then 6 months of rehab.

I am going to predict right now, if this happens, he will get Janelle to get licensed and have them kept in the house in HER possession. This makes me feel very uncomfortable for those children!
This is not how it works. If he’s a felon, there should not be firearms at the residence. Janelle cannot transfer it to her name and keep it at the swamp. She can have his guns, if she transfers to her name but to take possession of it she would have to live in a different home.
If there’s a temporary protective order on David, for the assault on Jace, most likely he doesn’t have a gun to his name. You can’t have firearms if there’s a P.O. in place. Cops will come to your residence and remove your guns until/if a judge dismiss your case.
David has more than likely removed them already, and Jenelle is busy cleaning out the she shed.
